Acceptance of these terms

By accessing or using jerrythai.com or the client portal (the “Site”), you agree to these Terms of Use. If you do not agree, please do not use the Site. You must be at least 18 years old to create an account.

The service

The Site is the marketing website and client portal of Jerry Thai, a REALTOR® with MaxWell Capital Realty. It is provided for general informational purposes to help you explore Calgary-area real estate.

Listing and MLS® data

Property listing information is provided under license from Pillar 9™ MLS® and is deemed reliable but not guaranteed accurate. It is made available for your personal, non-commercial use to identify properties you may be interested in. You may not scrape, harvest, bulk-download, redistribute, or republish any listing data. Access to gated market data is additionally governed by the portal terms you accept at registration.

Your account

You agree to provide accurate information, to keep your sign-in credentials secure, and that you are responsible for activity under your account. We may suspend or deactivate accounts that violate these terms.

The portal is a service Jerry provides to his registered clients. When you register, your portal activity — the homes you save and how you label them, your saved-search filters, the communities you watch, and a summary of your activity — is visible to Jerry, with your name and email, so that he can assist you. Your private notes and the names you give your searches and folders remain private. See our Privacy Policy for details.

Acceptable use

You agree not to use the Site for any unlawful purpose, to interfere with its operation or security, or to access it through unauthorized automated means.

Intellectual property and trademarks

Site content is owned by Jerry Thai or its licensors. The trademarks REALTOR®, MLS®, and associated marks are owned by The Canadian Real Estate Association (CREA) and used under license; Pillar 9™ owns the copyright in its MLS® System. You may not use these marks or our content without permission.

No professional advice; no agency

Content on the Site is not legal, financial, tax, or real-estate advice, and automated valuations are estimates, not appraisals. Using the Site does not create an agency or client relationship. For advice about a specific transaction, please speak with Jerry Thai or another qualified professional.

Disclaimers

The Site is provided “as is” and “as available,” without warranties of any kind, including as to accuracy, availability, or fitness for a particular purpose.

Limitation of liability

To the fullest extent permitted by law, Jerry Thai and MaxWell Capital Realty will not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or reliance on its content.

Third-party links

The Site may link to third-party websites or services that we do not control. We are not responsible for their content or practices.

Changes to these terms

We may update these Terms from time to time. Continued use of the Site after changes take effect means you accept the revised Terms.

Governing law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there, and the courts of Alberta have jurisdiction over any dispute.
