Overview
This Privacy Policy explains how Jerry Thai, a REALTOR® with MaxWell Capital Realty (“we,” “us”), collects, uses, discloses, and protects personal information through jerrythai.com and our client portal. We handle personal information in accordance with Alberta’s Personal Information Protection Act (PIPA) and Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA).
Information we collect
Information you provide. When you use our contact form we collect your name, email, phone number, your message, and the inquiry details you choose (preferred contact method, timing, and any listing or search you reference). When you register for the portal we collect your email and name (and basic profile information from Google if you sign in with Google), plus content you create — favourites, search alerts, watched communities, recently-viewed listings, and — if you use the home-valuation feature — your home address together with the monthly value estimates we generate for it.
Information collected automatically. We use a cookieless analytics service that measures aggregate page views. Our servers keep security and error logs (which may include your IP address, browser user agent, and the page requested), and our contact form records your browser user agent and the page you submitted from. For signed-in members we record product-usage events tied to your account — sign-ins, listings you view, and whether our emails are opened or their links clicked — to power features like recently-viewed and to measure email relevance. (Email open and click tracking is the same practice disclosed in the portal terms you accept at registration.)
Site analytics. We record first-party page-view events for every visitor (including visitors who are not signed in) — the page path, the originating site (referrer domain), and a per-visit session identifier — to understand how the site is used. These events carry no listing prices or addresses. For signed-in members, page-view events are associated with your account (which pages you visit, including portal pages and listings).
Security identifiers. To prevent abuse and rate-limit our forms and sign-in flow, we store salted hashes of your IP address and, for sign-in throttling, your email — never the raw values in those security logs.
Cookies and local storage.We set only essential cookies needed to keep you signed in. Your light/dark theme choice is stored in your browser’s local storage. We also store a per-visit analytics identifier in your browser’s session storage, cleared when you close the tab (not a cookie, not used for cross-site tracking). We do not set advertising or cross-site tracking cookies. Listing pages embed Google Maps, which may set its own cookies or storage governed by Google’s privacy policy.
How we use your information
We use your information to respond to your inquiries; to provide and personalize the portal (alerts, digests, favourites, recently-viewed); to send transactional and opt-in emails and measure their engagement; to protect the site (rate-limiting and bot detection); to understand aggregate usage; and to meet our legal and MLS® obligations.
Email communications and consent
We send newsletter and community-watch digest emails only with your express consent — recorded when you opt in or save a community watch. Every commercial email identifies us and includes a working unsubscribe link, and you can manage all email preferences in your portal settings, consistent with Canada’s Anti-Spam Legislation (CASL).
Home valuations are estimates
Any home-value figures we provide are generated automatically by a comparative-market-analysis model. They are estimates for general guidance, not a professional appraisal or an offer; Jerry Thai is happy to review an estimate with you on request.
How we share information
We do not sell your personal information. We share it only with service providers who process it on our behalf — including our database and authentication provider, email delivery provider, hosting and security provider, and a mapping service (address lookup for signed-in members runs server-side; your browser does not contact the mapping service directly for it). Property listing data is displayed under license from Pillar 9™ MLS®. We may also disclose information where required by law.
As a registered portal member, your activity is visible to Jerry so he can help you directly. He can see — with your name and email — your saved homes including the status labels you set, your saved-search filters, your watched communities, and a summary of your portal activity. Your private notes, the names you give your searches and folders, and any free-text keywords you type are never shared. Where Jerry contacts you by email, he does so under Canada’s anti-spam law (CASL), including identification and unsubscribe requirements.
MLS® listing data
Listings are shown under license from Pillar 9™ MLS® and are deemed reliable but not guaranteed accurate. Access to gated market data (such as sold prices) requires registration and acceptance of our portal terms.
Data retention
We keep personal information only as long as necessary for the purposes described above or as required by law. Recently-viewed, engagement, and analytics page-view events are pruned after roughly twelve months.
Community-level demand statistics (for example, how many members watch a community each week) are kept indefinitely as aggregate numbers only — they contain no names or account identifiers.
Security
Access to stored data is restricted by role-based access controls, and data is encrypted in transit. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
Your rights
You may request access to or correction of your personal information. You may withdraw your email consents or unsubscribe at any time — via the link in any email, or in your portal settings. Your portal activity is visible to Jerry for as long as you hold a portal account; if you would prefer it not be, contact us to close your account. If you are not satisfied with our response, you may contact the Office of the Information and Privacy Commissioner of Alberta (oipc.ab.ca) or the Office of the Privacy Commissioner of Canada (priv.gc.ca).
Children
This site is intended for adults and is not directed to children. We do not knowingly collect personal information from anyone under 18.
Third-party links
Our site may link to or embed third-party services. We are not responsible for the privacy practices of those services; their own policies apply.
Where your data is processed
Our service providers may store and process information on servers located outside Alberta, including in the United States. Where that occurs, the information is subject to the laws of those jurisdictions.
Changes to this policy
We may update this Privacy Policy from time to time. We will revise the “Last updated” date above and, for material changes, take reasonable steps to notify you.
